TERMS AND CONDITIONS OF SERVICE

These Terms and Conditions (hereinafter "Terms") govern the access to and use of the website https://www.google.com/search?q=kinetixtables.com (hereinafter "the Website") and the reservation management services (hereinafter "the Services") provided by VELINOV, BOZHIDAR BORISLAVOV (LKJ LEAP DIGITAL) , with NIF Z2121211H and registered address at CL LOS GUIOS, NUM 1, ACANTILADO LOS GIGANTES, Puerta 240, Santiago del Teide, CP 38683, Tenerife, Canary Islands (hereinafter "the Provider").

By using our Services, you agree to be bound by these Terms. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

2. OBJECT AND DESCRIPTION OF SERVICES

The Provider offers a digital platform for restaurant reservation management ("Kinetix Tables"). The service includes, but is not limited to, digital booking logs, table management, and customer data organization. The Provider reserves the right to modify the technical specifications of the Service to adapt them to technological evolution.

3. PRICING AND TAXATION (IGIC)

All prices for the Services are indicated in Euros.

  • Canary Islands Residents/Businesses: Prices are subject to the IGIC (Canary Islands General Indirect Tax).
  • Mainland Spain/EU: Prices are subject to VAT/VAT or the reverse charge mechanism as applicable under EU law. The final price, including taxes, will be displayed before the completion of the subscription process.

4. RIGHT OF WITHDRAWAL

Pursuant to the General Law for the Defense of Consumers and Users (LGDCU), if you are a "Consumer" (an individual acting outside of a trade or profession), you have the right to withdraw from this contract within 14 calendar days without giving any reason.

Exception: If you have requested the immediate commencement of the digital services during the withdrawal period and have logged into the software, you acknowledge that you lose your right of withdrawal once the service has been fully executed.

5. DATA PROTECTION (GDPR COMPLIANCE)

The processing of personal data is governed by our Privacy Policy. In accordance with Regulation (EU) 2016/679 (GDPR) and the Spanish LOPDGDD 3/2018 :

  • The Provider as Processor: Regarding the customer data uploaded by the Client (the Restaurant) to the platform, the Client is the "Data Controller" and the Provider is the "Data Processor."
  • Data Processing Agreement (DPA): By accepting these terms, both parties agree to comply with the obligations set forth in Article 28 of the GDPR. We ensure the implementation of technical and organizational measures to protect personal data.

6. SERVICE AVAILABILITY AND RESPONSIBILITY

While we strive for 99.9% uptime, the Provider does not guarantee uninterrupted access. We are not responsible for:

  • Interruptions caused by scheduled maintenance (notified in advance).
  • Failures in the Client's internet connection or hardware.
  • Loss of data due to unauthorized access to the Client's account resulting from the Client's negligence in protecting their credentials.

7. INTELLECTUAL PROPERTY

All content, software, logos, and trademarks on the Website are the exclusive property of LKJ LEAP DIGITAL or its licensors. The Client is granted a limited, non-exclusive, non-transferable license to use the platform for their business operations during the subscription period.

8. MODIFICATIONS

We reserve the right to modify these Terms at any time. Changes will be notified via email or a notice on our platform. Continued use of the Service after such changes constitutes acceptance.

9. ONLINE DISPUTE RESOLUTION (ODR)

In accordance with Article 14.1 of Regulation (EU) 524/2013, the European Commission provides a platform for online dispute resolution, which is available at the following link: https://ec.europa.eu/consumers/odr/

10. APPLICABLE LAW AND JURISDICTION

These Terms are governed by Spanish Law .

  • Consumer Contracts: Disputes will be resolved in the courts of the consumer's domicile.
  • Business-to-Business (B2B): Both parties expressly waive any other jurisdiction and submit to the Courts and Tribunals of Santa Cruz de Tenerife, Spain .
